These terms govern access to modmec.com and its public materials. Separate Simulator Terms govern the Generation Profile Simulator.
Effective July 27, 20261. Informational purpose
The website describes technology under development, completed prototype work, design targets, potential applications and modeled opportunities. It does not constitute an offer to sell, engineering design, performance guarantee, energy forecast, interconnection study, utility tariff, PPA quote, investment advice or commitment to build or host a project.
2. Performance statements
Objective results shown by the public-beta simulator or in illustrative charts depend on model assumptions and user inputs. They are not measured commercial performance. Any site-specific or commercial claim requires detailed engineering, verified data and appropriate independent review. Design targets and intended capabilities are forward-looking development objectives, not promises of final functionality.
3. Patent and intellectual-property wording
References to a granted Polish patent and a related pending U.S. national-phase patent application identify the status of the underlying tracker technology as of July 2026. Patent scope, ownership, validity, enforceability and commercialization rights are determined solely by official records, issued claims and applicable ownership or licensing agreements. No patent or other intellectual-property license is granted through this website.
4. Acceptable use
You may review and share links to public pages for legitimate business and evaluation purposes. You may not interfere with the service, bypass security, submit unlawful material, misrepresent a MODMEC output as an approval or certification, or use MODMEC names, marks or materials to imply a relationship that has not been authorized in writing.
5. No affiliation or endorsement
References to markets, customer categories, public data sources or potential use cases do not state or imply that a utility, customer, site operator, university, regulator or data provider has reviewed, approved, sponsored or endorsed MODMEC, the website or its model.
6. Third-party services and links
Third-party links and data sources are provided for context and attribution. MODMEC does not control their availability, terms, security or accuracy. Their inclusion does not create an affiliation.
7. Disclaimers
To the maximum extent permitted by law, the website and public materials are provided "as is" and "as available," without warranties of accuracy, completeness, merchantability, fitness for a particular purpose, non-infringement or uninterrupted availability. Nothing here limits a warranty that cannot legally be excluded.
8. Limitation of liability
To the maximum extent permitted by law, MODMEC and its officers, employees and contractors will not be liable for indirect, incidental, special, consequential, exemplary or lost-profit damages arising from reliance on the website or public-beta materials. This does not exclude liability that applicable law does not allow to be excluded.
9. Requests and submissions
You represent that you are authorized to submit project and business information. Do not submit confidential information unless MODMEC has agreed in writing to receive it on that basis. Submitting a request does not create a partnership, agency, exclusivity, utility relationship or binding project commitment.
10. Changes and contact
MODMEC may update these terms or the public-beta services. The effective date identifies the current version. Questions may be sent to office@modmec.com.
These terms are a risk-reduction draft for the current public beta, not a substitute for advice from counsel licensed in the jurisdictions where MODMEC will contract, market or run a pilot.
